1. Agreement to Terms

Welcome to InspectorsList.com (the "Site"), a website owned and operated by Inspector Network LLC ("we," "us," or "our"). These Terms of Service ("Terms") constitute a legally binding agreement between you, whether personally or on behalf of an entity ("you"), and Inspector Network LLC concerning your access to and use of the Site.

By accessing or using the Site, you agree that you have read, understood, and agree to be bound by all of these Terms. If you do not agree with all of these Terms, then you are expressly prohibited from using the Site and you must discontinue use immediately.

2. Description of Service

The Site provides a directory of home inspectors ("Inspectors") and related information to assist users ("Users") in finding and contacting inspection professionals.

InspectorsList.com is a neutral venue. We provide a platform for Inspectors to present their services and for Users to find them. We do not endorse, hire, recommend, or employ any Inspector listed on the Site. The Site's function is to provide a list of Inspectors; we are not a party to any agreement, transaction, or dispute between a User and an Inspector.

Promoted Listings: Some Inspectors may pay for a promoted listing to appear in designated advertising slots on the Site. These listings are clearly marked as "Promoted" or "Sponsored." The placement of promoted Inspectors within these slots is rotated algorithmically to ensure fairness. A promoted listing does not constitute an endorsement or recommendation by Inspector Network LLC.

3. Inspector Accounts & Responsibilities

Content Accuracy: When an Inspector profile is created, some initial information may be sourced from publicly available state inspector databases. An initial "About Me" section may be generated using artificial intelligence (AI) for convenience. The Inspector is solely responsible for reviewing, editing, and ensuring the continued truthfulness and accuracy of all information on their profile. Any information supplied or edited by the Inspector, including but not limited to credentials, licenses, insurance coverage, and service descriptions, must be true and accurate.

Prohibited Conduct: Inspectors must not misrepresent their identity, qualifications, certifications, or affiliations. Claiming to hold licenses or certifications that are not valid and current is a direct violation of these Terms.

Paid Services: Inspectors may purchase paid subscriptions to access additional features, such as displaying service pricing, communicating with potential customers, or securing a promoted listing. Advertising services are billed on a weekly basis. Failure to make payment will result in the disabling of paid services but will not automatically lead to account termination. All payments are subject to the terms of our third-party payment processor.

4. User Conduct & Review System

Verified Reviews: Users may submit reviews for Inspectors they have hired. To ensure authenticity, Users submitting a review must provide a copy of their invoice or inspection report from the Inspector. Our team will use these documents to verify that the reviewer was a customer of the Inspector.

Review Status: Until a review has been validated by our team, it will be clearly marked on the Site as "Not Yet Verified."

Review Content and Ownership: Reviews must be truthful and reflect the User's genuine experience. We reserve the right, at our sole discretion, to remove or refuse to post any review that we believe violates our policies, including reviews that contain harassment, spam, defamatory language, or are intended to maliciously harm a business. The User who posts the review retains ownership of their content; however, by submitting a review, you grant Inspector Network LLC a perpetual, worldwide, non-exclusive, royalty-free license to use, display, reproduce, and distribute the review on the Site and in our marketing materials.

5. Intellectual Property Rights

Unless otherwise indicated, the Site is our proprietary property. All source code, databases, functionality, software, website designs, text, photographs, and graphics on the Site (collectively, the "Content") and the trademarks and logos contained therein (the "Marks") are owned or controlled by us or licensed to us.

Content provided by Inspectors for their profiles remains their property, but by providing it, they grant us a license to display it as part of the Service.

6. Disclaimer of Warranties

The Site and the Service are provided on an "as-is" and "as-available" basis. You agree that your use of the Site and our services will be at your sole risk. To the fullest extent permitted by law, we disclaim all warranties, express or implied, in connection with the Site and your use thereof, including, without limitation, the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We make no warranties or representations about the accuracy, completeness, or quality of the work of any Inspector listed on the Site. We do not investigate the licensing status or background of any Inspector beyond reviewing initial public records. You are responsible for conducting your own due diligence before hiring any Inspector.

7. Limitation of Liability

In no event will Inspector Network LLC, our directors, employees, or agents be liable to you or any third party for any direct, indirect, consequential, exemplary, incidental, special, or punitive damages arising from your use of the Site or from any interaction, agreement, or dispute between you and any Inspector found through the Site.

Any dispute you have with an Inspector is directly between you and that Inspector, and you agree to irrevocably release Inspector Network LLC from any and all claims, demands, and damages of every kind and nature, known and unknown, arising out of or in any way connected with such disputes.

If we are found to be liable, our liability to you for any cause whatsoever and regardless of the form of the action will at all times be limited to the amount paid, if any, by you to us for the service during the three (3) month period prior to any cause of action arising.

8. Account Termination

We reserve the right, in our sole discretion, to suspend or terminate your account and refuse any and all current or future use of the Site for any reason, including for providing false or misleading information or for violating these Terms of Service. We will provide an opportunity for an Inspector to respond to complaints but may suspend an account during an investigation.

9. Governing Law and Dispute Resolution

These Terms of Service and your use of the Site are governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law principles. Any legal action of whatever nature brought by either you or us shall be commenced or prosecuted in the state and federal courts located in Brevard County, Florida, and the Parties hereby consent to, and waive all defenses of lack of personal jurisdiction and forum non conveniens with respect to venue and jurisdiction in such state and federal courts.

10. Modifications and Interruptions

We reserve the right to change, modify, or remove the contents of the Site at any time or for any reason at our sole discretion without notice. We also reserve the right to modify these Terms of Service at any time. We will alert you about any changes by updating the "Effective Date" of these Terms.
